Rather than giving you the bankruptcy petition and schedules to fill out and return to us, we gather information and documents from you so that we complete the bankruptcy paperwork, not you. We then go through the documents together before they are filed.

An attorney will meet with you to determine whether bankruptcy is the best option for you, complete the bankruptcy petition and schedules, and attend the 341 meeting with you. This means that your attorney fully understands your situation when explaining the advantages and possible issues that may arise. This means that your attorney is aware of the status of your case at all times. You will remain on your attorney’s radar and will not fall through the cracks.

Chapter 7 Bankruptcy Process

  1. Consultation: During your free initial consultation, we will analyze your case and discuss whether bankruptcy is the best option for you. We will answer any questions you have and will spend the time to ensure that you understand the process and consequences of bankruptcy.
  2. Information/Document Gathering: If you decide to retain us, we will provide you with a list of documents and information we need in order to complete the bankruptcy petition and schedules. Typically, the documents needed fall into the following categories: (1) income (pay statements, income taxes, etc.); (2) expenses; (3) assets; and (4) debt (invoices, statements, bills, collection letters, lawsuits, etc.). From these documents and information, we will prepare your petition for your review and signature. We typically request a week or 2 to complete the petition and schedules but, in emergencies, we can complete the paperwork and file within 24 hours.
  3. Meeting of Creditors: About 1 month after we file your bankruptcy, we will meet the chapter 7 trustee at a meeting of creditors, or a 341 meeting. Generally, the meeting will be attended by the chapter 7 trustee, the debtor, and the debtor’s attorney. However, creditors are given notice of this meeting are may attend to ask questions. The trustee will confirm information and ask questions based upon the information provided in the petition and schedules. We will meet with you beforehand to prepare you for the meeting.
